KUMC Faculty may present readings through the Virtual Classroom, when the following terms and conditions are met:

  • KUMC faculty have Fair Use rights to present copyrighted readings for classroom use for one semester only. Permission must be secured to continue using copyrighted readings in the Virtual Classroom once the Fair Use period has ended. Fair Use compliance will be managed by Academic Resources staff.
  • Acquiring permission to use copyrighted materials is the responsibility of KUMC faculty. Academic Resources staff will, on request, seek permission to continue using copyrighted materials. We will use the Copyright Clearance Center's (CCC) services to acquire permission to continue presenting copyrighted readings. The CCC charges two basic fees for this service (which we will pass along): $5.00 for every article processed, plus any applicable royalty fees. Contact Bob Pisciotta for further information. Following are CCC's conditions to permit licensing of copyrighted readings in the Virtual Classroom:
  1. Copyrighted readings in the Virtual Classroom may be presented to only one course (bearing a unique identifier as assigned by the institution, and thereby including all sections or other subparts of the course) at one institution;
  2. No more than 25% of the text of a book or of the items in a published collection of essays, poems or articles may be used;
  3. No more than the greater of (a) 25% of the text of an issue of a journal or other periodical or (b) two articles from such an issue, may be used;
  4. Electronic access to the material which is the subject of a permission must be limited by means of electronic password, student identification or other control permitting access solely to students and instructors in the class;
  5. The institution must present a clear statement that copyright permission has been received from the copyright owner for a specific class. Details about this requirement are available in this attached document.
  6. Any permission granted shall expire at the end of the class and, absent some other form of authorization, User is thereupon required to delete the applicable material from any electronic storage or to block electronic access to the applicable material.

Other KUMC Procedures for Copyrighted Readings:

  • Reserve requests may be placed via Pulse. Requests will be processed in the order in which they are received. No requests will be available for students on the day they are ordered. Allow up to 10 days for processing. To request online readings, use the following form:

Journal Articles

  • All readings to be presented in the Virtual Classroom will be scanned and processed into Acrobat/PDF files. These files are accessible via the World Wide Web to anyone using Adobe's free Acrobat Reader. This reader is already installed in student accessible workstations in the Instructional Technology Center and the Dykes Library. Free copies of the reader may also be found at the Adobe Acrobat Web Site.
  • All copyrighted readings presented in the Virtual Classroom will be managed by Academic Resources staff. These readings will be placed in directories controlled by Academic Resources staff, and password restrictions will be put in place. KUMC faculty may share the passwords with students in their classes, but with no one else.
  • Upon conclusion of the class, Academic Resources staff will remove existing links to copyrighted readings and, if necessary, move readings to publicly inaccessible directories.
